1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the TinyTalk mobile application, website at tinytalkstudy.com, and related services (collectively, the "Service") operated by TinyTalk Study ("we," "us," or "our").
By downloading, installing, registering for, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of the Service
TinyTalk provides AI-assisted voice and text conversation for language learning, tutoring-style feedback, and general assistant features. The Service may include:
- Push-to-talk voice recording and speech-to-text conversion;
- AI-generated text responses and optional text-to-speech audio playback;
- User accounts, profiles, and chat history;
- Persona and prompt customization.
We may modify, suspend, or discontinue features at any time with reasonable notice where practicable.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have parental or guardian permission.
The Service is not intended for children under 13. We do not knowingly collect personal information from children under 13 as described in our Privacy Policy.
4. Account registration & security
You may register with an email address and authentication credentials you choose. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Notify us immediately at support@tinytalkstudy.com if you suspect unauthorized access.
5. Voice recording, microphone & AI content
Important: The Service uses your device microphone only when you actively record (push-to-talk). Recordings are sent to our servers and third-party providers for transcription and AI processing as described in our Privacy Policy.
You agree that:
- You will not record other people without their consent where required by law;
- You are solely responsible for the content you submit (voice, text, images);
- AI outputs are generated automatically and may be inaccurate, incomplete, or inappropriate — they are not professional, legal, medical, or educational advice;
- You will verify important information independently before relying on AI responses.
6. Acceptable use
You agree not to:
- Violate any applicable law or third-party rights;
- Harass, threaten, defame, or distribute hate speech or illegal content;
- Attempt to reverse engineer, scrape, or overload the Service;
- Use the Service to develop competing models using our outputs without permission;
- Upload malware or interfere with security measures;
- Misrepresent your identity or impersonate others.
We may suspend or terminate accounts that violate these rules.
7. Subscriptions & payments
If paid features are offered, pricing and billing terms will be shown in the app and processed by Google Play or Apple App Store. Refunds follow the applicable store policies. We do not control store billing disputes.
8. Intellectual property
The Service, branding, software, and design are owned by us or our licensors. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes unless otherwise agreed in writing.
You retain ownership of content you submit. You grant us a license to host, process, and display your content solely to operate and improve the Service.
9. Third-party services
The Service integrates third-party providers (e.g., cloud hosting, OpenAI for language models, ElevenLabs for voice synthesis). Your use is also subject to their terms and policies. We are not responsible for third-party services outside our reasonable control.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted, error-free, or secure operation, or that AI outputs will meet your expectations.
11. Limitation of liability
To the maximum extent permitted by law, we and our affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the Service.
Our total liability for any claim shall not exceed the greater of (a) amounts you paid us in the twelve months before the claim, or (b) USD $50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Termination
You may stop using the Service at any time and request account deletion per our Privacy Policy. We may suspend or terminate access for breach of these Terms or legal requirements.
13. Governing law & disputes
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your country require otherwise.
Disputes shall first be addressed through good-faith contact at support@tinytalkstudy.com. Where permitted, courts in Seoul, Korea shall have exclusive jurisdiction.
14. Apple App Store & Google Play
If you downloaded the app from Apple App Store or Google Play:
- These Terms are between you and TinyTalk Study, not Apple or Google;
- Apple/Google are not responsible for the Service or its content;
- Apple/Google have no obligation to provide maintenance or support for the app;
- You must comply with applicable store terms of use;
- Apple and its subsidiaries are third-party beneficiaries of these Terms if you use the iOS app, and may enforce them against you.
15. Changes & contact
We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
